Scope and product terms

These terms apply to the Capsa Nigra website and to Capsa Nigra apps for Windows, iOS and Android. Installing, accessing or using an app means accepting these terms. A product page, checkout, store listing or in-app notice may add product-specific terms; those specific terms control for that product if they conflict with this general document.

Photo Archive Rescue has separate product terms covering its Free Edition, Full License and Lemon Squeezy subscription.

App stores and licence

Apps are licensed, not sold. Subject to these terms and the applicable store rules, Capsa Nigra grants the user a limited, personal, non-exclusive, non-transferable and revocable licence to use the app on devices the user owns or controls for its intended purpose.

For an app obtained from Apple, Apple’s Standard Licensed Application End User License Agreement applies unless the store listing presents a valid custom licence agreement. Apple and its subsidiaries are third-party beneficiaries of the applicable licence terms and may enforce them. For an app obtained through Google Play, the Google Play Terms of Service and other applicable Google terms also apply. If a mandatory store term conflicts with these terms, the mandatory store term controls.

Accounts, purchases and subscriptions

Some apps may not require an account. If an app offers accounts, the user is responsible for accurate information, device security and authorised activity. Account deletion is available inside an account-creating app and through the external request route on the support page.

Prices, billing periods, trials, automatic renewal, cancellation and refund rules are shown before purchase by the applicable store or payment provider. Manage an Apple or Google subscription through the store account used to buy it. Deleting the app or an app account does not itself cancel a store subscription. Refund rights are governed by the applicable store, checkout terms and mandatory consumer law.

Acceptable use

Use the app and website lawfully and only with content and accounts you are authorised to use. Do not misuse a service, bypass access or usage controls, interfere with security, distribute malicious content, resell a personal licence, or copy, modify, reverse engineer or redistribute an app except where applicable law expressly permits it.

User content and device data

Users retain ownership of their content. A local-first app does not acquire ownership of files it processes. Where an app needs limited rights to process user content or transmit it to a chosen service, those rights are limited to operating the requested feature and are described in the app-specific notice.

Users are responsible for appropriate backups and for reviewing an app’s output before relying on it. Removing an app, cancelling a subscription or deleting an account may make app-managed data unavailable.

Third-party services

An app may interact with Apple, Google or another identified service. Those services have their own terms and privacy policies, and Capsa Nigra does not control their availability or independent decisions. References to third-party products or trademarks do not imply endorsement unless expressly stated.

Updates, availability and support

Apps and features may be updated, changed or discontinued, subject to applicable law and store rules. Device, operating-system and regional compatibility may change. Support is provided through /support/; Capsa Nigra, rather than Apple or Google, is responsible for product support except where the applicable store terms say otherwise.

Warranties and liability

Apps and the website are provided with the warranties that cannot lawfully be excluded. Otherwise, to the maximum extent permitted by law, they are provided as available without additional implied warranties. Capsa Nigra does not promise uninterrupted operation or that an app will meet every individual requirement.

To the maximum extent permitted by law, Capsa Nigra is not liable for indirect, incidental, special or consequential loss. Nothing in these terms excludes or limits liability or consumer rights that applicable law does not allow to be excluded or limited.
